Dissension Among Dems

It may be the proverbial tempest in the teapot, but the quarrels among Democrats, both local and statewide, continue to boil over.

The Shelby County Democratic Party (SCDP) may or may not have fully recognized official leadership as a result of contradictory recent actions taken by state chairman Hendrell Remus and the local party executive committee.

Remus started the turmoil by a surprise announcement, weekend before last, that he was removing local party chair Lexie Carter from her position as head of the SCDP. This was in the immediate wake of the local party’s annual Kennedy Day banquet, which drew a sizeable crowd of attendees and, according to Carter, raised $40,000 for party coffers.

Remus said the basis of his action was Carter’s failure to prepare an acceptable plan for the November election in response to his request for one in a questionnaire sent to Carter. As needy but overlooked Democrat campaigns, he mentioned specifically that of District 97 state representative candidate Jesse Huseth, who opposes Republican incumbent John Gillespie, and that of Gloria Johnson of Knoxville against GOP U.S. Senator Marsha Blackburn.

But, according to Carter, the state chair’s action was more likely due to a series of conflicts that occurred between Remus and herself and others at the Democratic National Convention in Chicago in August.

In any case, Remus’ action has not gone unchallenged. Both his decision and the authority to take it have been challenged, locally and at the state level.

Speaking for himself and what he said was a sizeable portion of the state Democratic committee’s membership, Erick Huth of Shelbyville, until recently a member of that committee from state District 14, said the party’s bylaws did not permit Remus to remove a local chairman without expressly granted permission from the state body.

Remus had said he vetted in advance his removal of Carter with several West Tennessee vice chairs of the state party, but, said Huth, such a claimed consultation, even if accurate, would not have authorized Remus’ removal action.

Huth, who in August lost an election to retain his state committee seat, said that fact enabled him to speak more freely about party matters, including what he said was Remus’ high-handed and ineffective conduct of his chairmanship.

“The state committee is badly divided, and that’s largely due to Hendrell,” he said.

An active state committeeman from Nashville, who chose not to be identified, confirmed Huth’s analysis of things.

For the record, Hendrell Remus has opted not to be a candidate for reelection as chair in state committee elections scheduled for January. According to various sources, Remus intends to return to Memphis, his former home base, in order to scout a possible future run for an elective position.

Meanwhile, the executive committee  of the local SCDP met late last week in Whitehaven and, in a highly argumentative session, engaged in disagreements among themselves as well as with state chair Remus about the whole brewing matter.

The local committee declined in its turn to accept Remus’ changes, which included the naming of four proposed temporary co-chairs for the SCDP.

These were former state Representative Dwayne Thompson, Memphis City Council Chair JB Smiley Jr., Shelby County Commission Chair Miska Clay Bibbs, and veteran party figure Danielle Inez. The proposed new co-chairs were invited to speak their piece on ideas for the party and the fall election, but their status as party leaders was not confirmed.

Instead, in the absence of both Lexie Carter and Hendrell Remus from the meeting, the local committee named as acting SCDP chair Will Simon, who is a current state party vice chair.

None of these changes, by the state chair or the SCDP committee, would seem to be anything but ad hoc expedients, as the situation simmers on.

New SCDP elections are scheduled for December.

Musical Chairs

“Shock waves” is too strong a term for the reaction, but a fair number of eyebrows have been raised by the surprise action of state Democratic Party chair Hendrell Remus in removing from power local Shelby County party chair Lexie Carter.

The action took place Thursday following a Zoom call between Carter, Remus, and others. Invoking what the state chair said was the absolute authority of the state party over local parties, Remus said Carter had not measured up to the needs of a coordinated Democratic campaign for the fall election.

He mentioned specifically the campaigns for District 97 state representative of Jesse Huseth, who opposes Republican incumbent John Gillespie, and that of Gloria Johnson of Knoxville against GOP U.S. Senator Marsha Blackburn.

Remus said he had sent a questionnaire to Carter asking for details of the local party’s readiness for election activity and received insufficient information in response.

Carter professed to be taken by surprise by her removal, having just, as she maintained, presided over the local party’s annual Kennedy Day banquet on September 5th and grossed upwards of $40,000 for party coffers.

She alleged that a number of disagreements and confrontations had occurred between herself and Remus at the recently concluded Democratic National Convention in Chicago.

Remus had apparently been considering the removal action well in advance, having discussed the possibility with potential ad hoc successors to Carter the previous week. 

He said he would appoint four temporary co-chairs to guide the Shelby County Democratic Party (SCDP) until December, when a local party election would be held. The Flyer has learned that two of those invited to serve in that capacity are outgoing state Rep. Dwayne Thompson and City Council Chair JB Smiley. 

Former local party chair and ex-County Commissioner Van Turner, who had assisted Carter in answering Remus’ questionnaire, raised concerns about due process in Carter’s removal and likened his action to the state Republican Party supermajority’s attempt to dominate over the actions of local government.

The new developments recalled the situation of 2016 when then-state Democratic chair Mary Mancini disbanded the Shelby County party following years of local controversy, including charges of embezzlement.

The local party was reconstituted in 2017 with Corey Strong as chair. So far, no names have surfaced as potential local candidates for the permanent chairmanship of SCDP.

As it happens, Remus will be giving up his own chairmanship in January, when his elected term ends. So far the only known candidate to succeed him is Rachel Campbell, chair of the Hamilton County (Chattanooga) Democratic Party and vice chair of the state party.

• Sarah Wilkerson Freeman, the Democratic nominee for the 8th District congressional seat, confirms that Susan Boujnah, a videographer who accompanied her to last month’s Democratic National Convention, is hard at work on an official campaign video, which will be released (presumably via social media) within the month.

Though Freeman has issued no formal debate challenge to Republican incumbent David Kustoff, Freeman observed that the NAACP will be holding an open forum for area candidates in Collierville on October 8th and that Kustoff is among those invited to participate.

Freeman, a resident of Germantown, likes to say she lives “within spitting distance” of her opponent.

• Former U.S. Senator Jim Sasser died at his North Carolina home last week. Sasser represented Tennessee in the Senate from 1977 to 1995 and later served as ambassador to Japan.

Mike Cody, Influential Memphian, Has Died

W. J. Michael “Mike” Cody, an influential Memphian in the fields of law and politics, died Sunday at the age of 88 at Baptist Memorial Hospital after a lengthy illness.

Cody was well known as a reformer, even before his first tenure in local government as a city councilman from 1975 to 1977. He had been one of the local legal advisers to Dr. Martin Luther King, Jr. in 1968 and had helped King strike down a ban on a second march on behalf of striking sanitation workers, mere hours before the fateful assassination of the civil rights leader.

In the wake of that tragedy, Cody collaborated with the Rev. James Lawson in forming the organization that became Memphis Legal Services.

Cody was appointed by President Jimmy Carter as U.S. Attorney for the Memphis district in 1977 and served through 1981. When Memphis Mayor Wyeth Chandler resigned to become a judge in late 1982, Cody became a candidate in a special election to succeed Chandler.

He would finish a strong third in that race, behind J.O. Patterson and Dick Hackett, the eventual runoff winner. In 1984, Cody, a Democrat,  was appointed state Attorney General, across party lines, by Republican Governor Lamar Alexander, serving until 1988.

Cody, a renowned athlete during his college years at Southwestern at Memphis (now Rhodes College), was also well known as an inveterate runner who participated in numerous marathons. He was named to the Tennessee Sports Hall of Fame. He was also the author of a 1992 book, Honest Government: An Ethics Guide to Public Service.

Memphis Congressman Steve Cohen remembered Cody this way:I knew Mike Cody all of my adult life. He was a highly respected attorney and public official, and was scrupulously honest. He did admirable service for Memphis, Tennessee, and the United States. As Lucius Burch would say, ‘The hair of the hypocrite was not seen about him.’ I extend my sincere condolences. His was a life well-lived.”

Cody is survived by his wife, Suzanna Cody; two daughters, Jane Cody of Corrales, New Mexico, and Mia Cody of Memphis; a son, Michael  Cody of Germantown; three grandchildren, and two great grandchildren.

Tag Teaming a Grant

“We’ve secured $13.1 million in federal funding to overhaul one of the most dangerous intersections in our city — Lamar Avenue, Kimball Avenue, and Pendleton Street.”

So begins an online notification from the office of Memphis Mayor Paul Young, and it is accompanied by a photograph of the mayor with U.S. Secretary of Transportation Pete Buttigieg.

The notification goes on to boast that “[w]e’re not just fixing a dangerous intersection — we’re transforming it with clearer signals, safer crosswalks, and better pedestrian pathways” — all of it being “a huge step towards ensuring that every Memphian can navigate our streets with confidence and peace of mind.”

Sounds good all right. I remember that intersection from the days when, as a 14-year-old, I threw the old Memphis Press-Scimitar in that neighborhood. In vintage times, it was where the old streetcars did a turnaround, and it absolutely was hazardous to negotiate, especially on a bicycle.

And comes yet another online notification — this one from 9th District Congressman Steve Cohen: “I’m pleased to announce a new investment of $13.1 million [under the] Infrastructure Investment and Jobs Act … to completely redesign the dangerous intersection at Lamar Avenue, Kimball Avenue, and Pendleton Street …”

The congressman, a senior member of the House Transportation and Infrastructure Committee, notes further, “I strongly advocated for this project and for funding to improve our streets in hearings with Secretary Buttigieg and in letters of support to the U.S. Department of Transportation, and I’m proud we brought it home.”

Well, er, to whom goes the honor of having snagged this benefit from the feds? The mayor or the congressman?

Both, as it turns out. Asked about it, Cohen calls it a “cooperative joint effort” and says, in a text, “The mayor was a planner, and they’re his people. Politics and pitching by congressmen certainly helps. … Grants don’t just fall out of a coconut tree.”

And credit for the grant goes even further. Cohen points out that the grant, in its original form, was first proposed by former Mayor Jim Strickland and had been included as an earmark in legislation that, before being resurrected, was stalemated in a previous session of Congress.

All of which is to say that, yes, it does indeed take a village to get things done.

• Perhaps unsurprisingly, the vote of the Shelby County Commission on Monday to support the City Council’s lawsuit against the Election Commission to restore a gun-safety referendum on the November ballot was passed on a party-line vote — nine Democrats aye, four Republicans no.

Speaking for the Republicans, Commissioner Mick Wright quoted Governor Bill Lee’s concerns, expressed earlier Monday in Memphis, that the city should find itself at odds “with the rest of the state.” Democratic Commissioner Henri Brooks countered that it was “time to stand up to bullies.” And other commissioners tended to follow their party’s line.

With its vote, the commission became an “amicus curiae” in support of the suit, which has caused various GOP state officials to talk ominously about withholding shared state funding from Memphis.

• Citing the prosecution in Georgia of a father who armed his son with an AR-15 used in a fatal school shooting, Democratic state Rep. Antonio Parkinson says he intends to re-introduce his measure to penalize “a person who illegally transfers a firearm to a minor” using it for criminal purposes. Parkinson’s bill was introduced in last summer’s special session on gun safety but was tabled by the majority Republicans.

Showdown!

It is no accident that many savants in the legal/political universe regard the 1962 Baker v. Carr decision of the U.S. Supreme Court to be second to none among landmark judicial decisions.

This decision was brought on by a suit from Charles Baker, chairman of what was then the Shelby County Court, precursor of the present Shelby County Commission. On behalf of Shelby County, rapidly urbanizing at the time, as was the nation as a whole, Baker sought relief from un-democratic districting guidelines imposed by the state of Tennessee that unduly favored the state’s rural population.

The court held in essence that the Fourteenth Amendment required that the principle of one person-one vote be applied in the determination of legislative district lines.

While the decision had immediate and lasting repercussions on determining matters of voter eligibility, both in Tennessee and elsewhere in the nation, it has by no means eliminated gerrymandering based on partisan politics (e.g. witness the Republican legislative supermajority’s strip-mining away of Democratic Party rights in Nashville’s Fifth Congressional District), nor has it much diminished the edgy relationship between urban and rural interests in policy-making.

The latter issue has flared up again in the quarrel over whether Memphis voters should be allowed to vote their preference on several gun-control measures embedded in a referendum proposed by the city council but now endangered by the action of the county Election Commission in removing it from the November ballot.

In so acting, the Election Commission — dominated 3-2 by GOP members according to state mandate — has clearly responded to overt threats from the state’s Republican leadership to withhold from the city some $78 million in state revenues, if the referendum should go through as scheduled.

This was some of the “stiff resistance” promised by House Speaker Cameron Sexton, who articulated things this way: “Local governments who want to be progressive and evade state laws will lose shared sales tax funding.” The speaker likened the city’s referendum plans to “subversive attempts to adopt sanctuary cities [and] allow boys in girls’ sports.” 

Some Memphians were expressing concern that the state’s retribution could also be visited on various large local projects dependent on previously pledged state subsidies, like those involving the zoo, FedExForum, and Simmons Bank Liberty Stadium.

It is worth recalling the actual import of the endangered referendum, authorized earlier by the council’s unanimous vote. In the words of its chief sponsor Councilman Jeff Warren, “Memphis voters will be asked whether they approve amending the city’s charter to require a handgun permit, restrict the storage of guns in vehicles in many cases, ban assault weapons sales after January 1, 2025, and enact extreme risk protection orders, sometimes called Red Flag Laws.”

All the referendum would do is solicit voter opinion, it would seem. Sexton chooses to see it otherwise, as a direct challenge to state authority.

Whichever interpretation is correct, the ongoing confrontation between city and state over a host of policy matters, of which gun safety is only one, is rising to fever pitch, as evidenced the rhetoric employed last week by Council Chair JB Smiley and various supportive council members, who announced their intent to sue the Election Commission to reinstate the ballot measure.

“Memphis has been shot and is bleeding out,” said Councilwoman Jerri Green. “We won’t back down, and we damn sure won’t be bullied,” proclaimed Smiley.

Memphis Mayor Paul Young meanwhile seemed to be trying to position himself at the nonexistent calm center, saying he understood the council’s “frustration” but expressing the view that the referendum ultimately would be “futile.”

Name-Checking 2026

Politics is like any professional sport you could name in that new rosters, new seasons, and new players are undergoing formation and preparation even as current contests are grinding to a conclusion.

To be specific, there is a ferment of activity in Shelby County right now, aimed at the elections of 2026. Two positions in particular already have potential candidates looking at them seriously and making plans.

The positions are those for Shelby County mayor, where current Mayor Lee Harris will be completing his term-limited time in office, and the 9th District congressional seat, held against all comers by incumbent Democrat Steve Cohen since his election there in 2006.

County mayor: At least six Democrats are looking seriously at the idea of seeking what will be an open seat. (Note: There may well be Republicans eyeing it as well, but, the county’s demographic imbalance being what it is, the GOP is as fundamentally handicapped in seeking local office as Democrats are in attempting to crack the Republican supermajority statewide.)

Melvin Burgess, the current assessor, is known to be contemplating a run for county mayor. He’s been thinking out loud about it since his time serving on the county commission from 2010 to 2018.

His experience in office and genial personality, coupled with the lingering resonance with voters of his father, Melvin Burgess Sr., an erstwhile police chief, give him a leg up.

Harold Collins, the current CAO for Shelby County Government and former city councilman and candidate for city mayor, has acknowledged the likelihood of a race for county mayor and is all but announced.

J.W. Gibson, the mega-developer and former county commissioner who ran for Memphis mayor last year, is holding meet-and-greets with an eye toward a county mayor’s race.

JB Smiley Jr., the erstwhile gubernatorial hopeful now serving as chair of the Memphis City Council, is being somewhat coy about it but has convinced friends he’ll seek the county mayor’s job as a logical stepping-stone from his present power position.

Mickell Lowery is the son of Myron Lowery, a former well-known local city councilman who served a temporary term as Memphis mayor. Having successfully acquitted a term as county commission chair, the younger Lowery is considered ripe for advancement.

Heidi Kuhn, the current Criminal Court clerk, is known to be actively preparing a race for county mayor, one based both on her activist conduct of her present job and her highly saleable personal qualities.

• The outlook for the 9th District congressional seat is somewhat different, in that the seat won’t be open unless the present long-term incumbent, Democrat Steve Cohen, chooses to vacate it.

There is no current indication that Cohen is so minded, and his record of responsiveness to this majority-Black district, along with his unbroken string of successes against a string of name challengers make a direct challenge to Cohen almost prohibitively difficult.

Yet potential candidates are in the wings. Most obvious is current County Mayor Harris, whose prior legislative service on the city council and in the state Senate, where he was Democratic leader, whetted his appetite for such a job. His credentials have meanwhile been enhanced by strong service as an activist mayor.

Another prospect is District 86 state Representative Justin J. Pearson, whose strong activism and oratorical prowess, freshly demonstrated at the just concluded DNC, suit him for a rise in the political ranks.

And yet another prospect, if an open race should develop, is state Senator Raumesh Akbari, unique as a Democratic legislator who enjoys wide respect across political lines and has something of a national reputation as well.

Snapshots of a Feeling

CHICAGO — All the president’s men, women, courtiers, and supporters and well-wishers of all stripes were surely attuned to his appearance Monday night at Chicago’s United Center.

It was not Joe Biden’s farewell to public life — he would continue to campaign for the Democratic ticket, he promised — but it was his sayonara song as head of that ticket. For all the pre-planned choruses of “We Love Joe!” and “Thank You, Joe!” emanating from the massive arena crowd, it was impossible not to see the man’s deep regret as he spoke, dry-throated, in anapestically rising cadences, of his achievements and unfinished ventures as president: the post-pandemic recovery act, the lessoning of Big Pharma, the infrastructure initiatives, the re-establishment of NATO solidarity, and all the rest.

“Bittersweet” doesn’t begin to do it.

Nevertheless, the torch was passed, the guard was changed, and Biden’s successor as standard-bearer, Kamala Harris, would make an appearance on stage to hug and embrace and celebrate her predecessor, along with members of Biden’s personal and official families.

The evening, first of a week’s worth to come in the 2024 Democratic National Convention, was replete with snapshots from the party scrapbook, new faces and old ones alike.

There was Alexandria Ocasio-Cortez — “AOC” in the vernacular — wildly applauded for the progressive congresswoman’s spicy personality and her recollections of working-class origins in New York.

There was Hillary Clinton, the defeated Democratic candidate from 2016, able now to voice rebukes of her conqueror (“We have him on the run now”) via hopes for the new avatar Harris (“Something is happening in America. You can feel it!”)

True Gretch with Tennessee delegation

• That there was a palpable feeling of hope and exhilaration as this convention began was undeniable. It was obvious, too, in the daily morning breakfasts of the Tennessee delegation at Chicago’s quite posh Hyatt Regency.

On Tuesday morning, another of the Democratic Party’s new stars, Michigan Governor Gretchen Whitmer (aka “True Gretch,” after the title of her just-published memoir), came into the delegation’s meeting room to deliver an energetic pep talk. She was followed somewhat later by an energetic exhortation from New Jersey Senator Cory Booker, who, after being introduced by Memphis Congressman Steve Cohen, stood atop a chair and, sans mic, declaimed his largish hopes for 2024.

The two national party figures bracketed remarks from a Tennessee hopeful, Gloria Johnson of Knoxville, who hopes to win what is certainly a long-odds contest with the ultra right-wing Republican incumbent U.S. Senator Marsha Blackburn.

Who knows? For the moment, all things seem possible for the Democrats, and their mood of optimism seems certain to crest at week’s end when Kam-ala (broad “a” in the accented first syllable) takes the stage for her official acceptance address.

Still on Call

Some readers might wonder: Whatever happened to Alisa Haushalter? The former director of the Shelby County Health Department, Haushalter was, not so long ago, one of the most visible people in the public eye as department head at the height of the Covid-19 pandemic.

By one measure — the fact that she was publicly accountable and on call on a daily, even hourly basis — she may have been for a time the single most visible of all local officials. Not only was she at the helm of the health department and having to cope directly with the scourge of Covid, managing local responses to it as best as she could; she had the responsibility of communicating every aspect of the disease’s progress and every important piece of data relating to its impact on the community. It was 24/7 and then some.

It is certainly arguable that Haushalter herself was one of the chief victims in Shelby County of the Covid-19 pandemic. Her work as the director was hailed as exemplary then and later by her associates in the department and in county government at large.

But, simply because of the prominence of her position, she was caught up in various controversies that owed more to the inherent disruptiveness wrought by the pandemic than to any actions she was responsible for.

Consider this a tease for a forthcoming lengthier, and possibly eye-opening, treatment of Haushalter’s pivotal and arguably heroic service on behalf of Shelby County in a time of crisis. Suffice it to say for the moment that political pressures relating to state vs. local issues played a large role in her decision, in February 2021, to step down as health department director.

But her service to Shelby County has continued. When she came here in 2016, after years of health service, first in Nashville and later at the renowned Nemours health complex in Delaware, she had a request of then-County Mayor Mark Luttrell, who hired her.

For three years, while working in Nashville, she had gone back and forth between the state’s two largest cities working on her doctorate, which she got from the University of Tennessee Health Science Center.

“When I was in Nashville,” she recalls, “I had dual appointments. I taught at Vanderbilt, and I was at the health department there. So when I came here, part of my discussion with Mayor Luttrell was, ‘Can I have a dual appointment so that I’m still teaching?’” The answer was yes, and, while serving as health department director she taught health policy at UT. 

Her thinking was eminently commonsensible. “That really was sort of how I came back to Tennessee. You learn along with the students, and the students get to learn from someone who has experience, not just what they’re getting from reading the book. And so it has always been a good match.”

Upon leaving the department, Haushalter would expand her teaching load to include, currently, healthcare economics and population health.

She has never departed from the idea of service. She’s still very much here and on the case, keeping her hand in — learning, doing, and teaching. Aside from her regular students, she says, she’s still on call at the department. “There are team members over there that still reach out to me that I coach or mentor.”

Her bottom line: “I’m committed to public health, I’m committed to nursing and have spent decades doing that. And I’m committed to Shelby County.”

Cohen, Sawyer, Salinas, Johnson Among Election Winners

There were no major — or even minor — surprises in the August 1st round of elections in Shelby County.

In the only county general race on the ballot, Democratic nominee Tami Sawyer defeated Republican nominee Lisa Arnold by 40,383 votes to 34,563 for the position of General Sessions clerk.

In the tightest race on the state and federal portion of the ballot, for the Democratic nomination for the open District 96 state representative seat, Gabby Salinas eked out a close win over runner-up Telisa Franklin, 2,168 votes to 2,036.

Others, with their vote totals, were Eric Dunn, 397; David Winston, 281; and Orrden Williams Jr., 52. 

There being no Republican candidate on the November 5th ballot, Salinas becomes, ipso facto, the state Representative-elect.

In the Democratic primary for United States Senate, Gloria Johnson, state representative of Knoxville, overcame runner-up Marquita Bradshaw, a Memphian who had been an upset winner of a previous Senate primary four years ago.

Votes statewide were: Johnson, 22,255; Bradshaw, 16,857; Lola Denise Brown, 3,585; and Civil Millder-Watkins, 1,875.

In November, Johnson will oppose incumbent Republican Senator Marsha Blackburn, who won her primary with ease over Tres Wittum. The margin in Shelby was 25,2001 to 2,566.

In the Democratic primary for the 9th District U.S. representative seat, incumbent Steve Cohen easily won renomination. Votes were: Cohen, 29,818; Corey Strong, 7,115; M. Latroy A-Williams, 1,928; Kassandra L. Smith, 1,507.

Cohen will be opposed in November by Republican Charlotte Berman, who was unopposed in her primary.

In the Democratic primary for the 8th District congressional seat, Sarah Freeman won nomination with 2,661 votes. Others were: LunetteWilliams with 905 votes; Brenda Woods, 824; Leonard Perkins, 538; and Lawrence A. Pivnick, 762.

In November, Freeman will oppose incumbent Republican Rep. David Kustoff, who was unopposed in his primary.

In the Republican primary for state representative, District 97, incumbent John Gillespie defeated Christina Oppenhuizen, 4,910 votes to 236. He will be opposed in November by Democrat Jesse Huseth, who was unopposed in his primary.

In the Democratic primary for state representative, District 84, incumbent Joe Towns defeated Vernell Williams, 2,321 votes to 461.

In the Democratic primary for state representative, District 93, incumbent Rep. G.A. Hardaway defeated LaShanta Rudd, 2,209 votes to 730.
