Politics, Favors at MLGW Preceded Lee

Politics and special attention at MLGW preceded current CEO Joseph Lee and were extended to, among others, the former editor of The Commercial Appeal, according to e-mails obtained by the Flyer.

On March 29, 2002, then-MLGW CEO Herman Morris wrote an e-mail to communications manager Mark Heuberger and vice president Curtis Dillihunt about the “CA Editor Problem.”

Morris wrote that he received a handwritten note “from the editor of the CA with a letter of complaint from his wife” requesting Morris’ help in a billing matter.

“This could set editorial policy toward MLGW for years and must be handled with touch,” Morris’ e-mail says. “I tried to call him Thursday but he was not in. I will be out of town 4/1/02 but will call him when I return on Tuesday. I would like you to get involved and make sure that we handle this matter with sensitivity.”

The e-mail has not previously been reported by The Commercial Appeal in its coverage of politics and special treatment at MLGW. The CA editor at the time of the e-mail was Angus McEachran.

The e-mail was obtained by the Flyer from MLGW communications manager Gale Jones Carson on Tuesday, shortly before our deadlines. It continues:

“Finally, I need to develop a list of customers that require my personal awareness, attention, or staff intervention when they have problems. Generally, customers who can call me or the mayor at home should be on the list. The mayor(s); city councilmen; county commissioners; state legislators; congressmen; any city director; editor of the CA; news or station director of TV stations; hospitals; jails; airports; FedEx; other big plants or customers; Fred Smith, Jack Belz, Mike Rose, Ira Lipman, Maxine Smith, Carol Miller (my sister), Lori Miller (my niece), Haymond Turner (my inlaws), Tom Garrott, Ron Terry, Marc Jordan, Pat Tigrett, Dean Jernigan, Herman Ewing, Pitt Hyde, Ben Hooks, Jesse Turner, Russell Sugarmon, Bill Crawford, and Pete Aviotti.”

All in the Family

Full disclosure: At this time last week, I was planning to write about the incestuous relationship between MLGW and city government.

Of course, I was only going to talk about interlocking pensions and retirement benefits. But then came news about a list of elected officials that MLGW insiders considered friends and family.

The Commercial Appeal reported last week that Mayor Willie Herenton, along with City Council members Edmund Ford, Rickey Peete, E.C. Jones, Myron Lowery, Jack Sammons, and former council members John Vergos and Pat Vander Schaaf, were all included in MLGW’s “Third Party Notification” service, a program designed to alert friends and family if loved ones’ utilities are in danger of being cut off.

But the politicians’ cut-off notifications, if there were any, were slated to go right back to MLGW executives.

Talk about friends with benefits.

Gale Jones Carson, MLGW’s new director of corporate communications, sent out a statement this week saying that the list was compiled before Joseph Lee, the former city finance director, was appointed president of MLGW in 2004. And that people included on the list probably didn’t even know it existed.

“We know that it’s more than a decade old,” said Glen Thomas, supervisor of corporate communications for MLGW. “Judging from the people on there, it has to be pretty old.” Thomas said he didn’t know what steps MLGW executives would have taken if one of the politicians’ accounts became delinquent. One can assume, however, that if someone wanted to know about it, they probably would do something about it.

In her statement, Carson said she could not explain how or why certain elected officials were selected for third-party notification. If council members didn’t have knowledge their account was being flagged, that means MLGW executives — for whatever reason — were interested if certain individuals were ever at risk of getting cut off. Was the utility simply being nice? Or was it looking for leverage with members of the City Council?

Technically, MLGW is owned by the city. The council has to approve rate increases and budgetary items. But MLGW has its own CEO, CFO, and board. That leads to some interesting overlap.

Carson created a stir in January when she left her job as Herenton’s spokesperson to work for MLGW, “bought” her six years back from her previous employment at MLGW, added it to her time working for the city, and because she now had 12 years of service under her belt, started collecting her city pension. And an MLGW paycheck.

But last week City Council attorney Alan Wade determined that there was nothing improper about what Carson did, even if she did buy her time back right before retiring.

“That may seem unfair,” said Wade. “If she had bought her time back when she first came over to the city, it would have been $9,000 as opposed to $14,000. By waiting, she penalized herself.”

More than 30 other employees have used the system in the same way; five of those were with MLGW.

“The two pension plans are separate and distinct. They’re not one and the same,” said Wade. “If an MLGW employee comes to the city and is in payment mode, he or she cannot buy into our plan. They have to start fresh.”

Lorraine Essex, head of human resources for the city, said she doesn’t know why MLGW has a different pension plan than the city. “This is the way the plan was set up in the ordinance,” she said. “It didn’t just happen this way, but I’m not sure how old the provisions are. Probably older than some members of the council.”

That doesn’t explain why employees can transfer time from MLGW or the Memphis library to their years with the city, but don’t have to add their time together. Employees should get what they’ve earned; I just wonder why there is an option that leaves the public paying for a pension and a salary at the same time.

Right now, an underlying problem is the “12 and out” provision that lets both elected and appointed officials retire after 12 years of service with the city. The industry standard is more than double that and that’s what the city now uses. The “12 and out” provision was ended November 2004 but, because of grandfathering, may come up until 2016.

Politicians with third-party notification, on the other hand, looks to be a thing of the past. Herenton is strongly recommending that the board discontinue the program immediately. MLGW’s Thomas said he doesn’t know what will happen to the list or if there will be any legal ramifications for the utility.

But with a lawsuit pending and the feds investigating, it seems that when you join this family, it may be for life.

Ready or Not

Members of the Memphis City Council face one of the most important and trickiest votes of their political careers next week.

The issue is annexation, and the stakes include 37,000 new Memphis residents, population bragging rights, several million dollars a year in property taxes, and custody of seven schools in the annexation areas.

There are wild cards aplenty. Residents opposed to annexation, which includes the areas of Bridgewater east of Cordova and Southeast Extended south of Nonconnah/Bill Morris Parkway, are getting organized for next Tuesday’s public hearing. Mayor Willie Herenton is wary of expanding the city at a time when the police department is already stretched thin. And politicians, lawyers, and developers have already struck deals exempting a few neighborhoods next to the annexation areas, including the exclusive gated community Southwind and a subdivision adjoining the new Southwind High School, which is one of the main things driving the whole process.

Time is short. The annexation is supposed to take effect on January 1, 2007. The City Council has already approved it on two of the three required readings. The Land Use Control Board has approved the plan for implementing services. The new high school is scheduled to open next fall, taking students — most of them black — from Germantown and Houston high schools. Southwind High School will eventually become part of the city school system.

Here’s a closer look at the key issues and players.

Bragging rights. If the annexation goes through, Memphis will grow to just over 700,000 people. Thanks to previous annexations of Cordova and Hickory Hill, Memphis has been able to stay off of the list of shrinking cities such as Detroit and Buffalo. Memphis, currently the nation’s 18th-largest city, would become the 16th-largest.

Schools and race. Because of the surrounding neighborhoods and the boundary lines, Southwind High School will be a majority-black school the day it opens. In Memphis and Shelby County, the trend is that such schools steadily lose most of their white students, as Kirby High School did in the 1990s and as Cordova High School has more recently. The city school system is more than 90 percent black and Hispanic.

Germantown High School is a majority-black school even though the city of Germantown is less than 5 percent black. Many of those students will be shifted to Southwind.

Separate and unequal taxes. The annexation map creates three classes of citizens: Memphians, Shelby County residents, and provisional Memphians. In several places, all three groups share the same street and live within sight of each other, but the city residents will pay roughly twice as much in property taxes. Real estate agents and homebuilders sell subdivisions along Shelby Drive and other east-west roads with signs saying “COUNTY SCHOOLS” and “NO CITY TAXES.” A sign that says “MEMPHIS CITY LIMITS” might as well say “WEST NILE VIRUS ZONE.” One tax oasis, the Whisper Ridge subdivision by Signature Builders, is immediately west of the new high school and nearly surrounded by annexed territory.

Another kind of tax haven is represented by Southwind and Windyke, along Winchester. Residents negotiated their way out of annexation until 2013. For the next six years, 494 homeowners around the Southwind Tournament Players Golf Course will save as much as $30,000 a year, while 517 middle-class homeowners in Windyke will save about $1,500 a year. Collectively, county assessor’s figures show Memphis is exempting 1,011 homes and leaving $19.7 million in property taxes on the table.

Fear of foreclosures. Memphis, as everyone knows, is the bankruptcy capital of America. A real estate closing attorney and a developer say thousands of soon-to-become Memphians in Bridgewater are living on borrowed money, with little or no equity in their homes. Five or 10 years ago, they bought starter homes with interest-only loans. Put another $125 a month in taxes in their tight budgets and bankruptcy lawyers could be the next ones doing a land-office business.

Mayor Willie Herenton is on record saying that “mayors don’t annex” and that the Memphis Police Department needs 650 more officers. In previous annexations, Herenton’s division directors met with community groups to buck up their spirits. If the mayor criticizes the plan of services or is a no-show at the council meeting, it could make some council members decide to oppose annexation or take it off the table.

uncompromising position. An architect by trade, Marshall is the link with the Memphis City Schools and the Office of Planning and Development. He has been meeting with developers and planners for the city and county and the two school systems to draw the all-important line. He has mayoral aspirations, so don’t look for Herenton go out of his way to help. If this annexation goes through, it will be because of Marshall, not Herenton.

The black middle class: A fixation on the past plus the Memphis City Schools’ take-the-money-and-run certification of schools as low-income so that students can get free lunches gives a distorted picture of the city. The black middle class is thriving, among other places, in subdivision after subdivision in southeastern Shelby County. Rufus Washington, head of a neighborhood coalition opposed to annexation, has lived in his home for 13 years. There is a county public library less than a mile away on six-lane Shelby Drive and Germantown Road. Sheriff’s cars patrol the streets. Neighborhood children attend Highland Oaks Elementary School and Southwind elementary and middle schools, all county schools with higher ratings than city schools. The notion of “county services” as rural or second-class is outdated.

When is a deal not a deal? Putting off annexation for another day has its own problems. Memphis and surrounding suburbs reached a historic agreement on annexation reserve areas six years ago. If densely populated subdivisions that are clearly within the Memphis annexation reserve area cannot be annexed, then the deal is meaningless. The City Council represents 670,000 Memphians already in the city limits. Their taxes have helped pay for the roads, sewers, and schools in the suburbs. Now that the bills are due, will the council collect?

Costs and benefits: Property taxes account for 63 to 65 percent of city and county revenue, according to Shelby County trustee Bob Patterson. It takes roughly 12 years for an annexation to pay for itself, Patterson says, but less than that if libraries, schools, and fire stations are already built. But there’s another risk that can be called the Fox Meadows Factor. Twenty-five years ago, Fox Meadows was a thriving southeastern suburb near the then-new Mall of Memphis. After it was annexed, the mall closed and tax collections declined. The same thing is happening in Hickory Hill.

The bottom line. Annexation opponents’ best hope is delay, probably pegged to 2013, like Southwind and Windyke, in return for a promise not to file a lawsuit. If they simply engage in Memphis bashing, they will anger council members who may accuse them of being ungrateful freeloaders who don’t pay their share.

Proponents have to unite the city powers-that-be — including Herenton, Marshall, police director Larry Godwin, and Superintendent Carol Johnson — in a sales job and a promise of safe streets and safe schools. But the damage may already have been done.

Par for the Course

Members of the City Council aren’t interested in shying away from a challenge, even if there’s trouble with the green. Or greens, as the case may be.

Though the funding source remains unclear, the City Council voted last week to spend $180,000 to keep Davy Crockett golf course open through next June.

The course, considered the most challenging in the city, is also the least played and the most difficult to maintain. During budget talks last spring, the parks division had slated Crockett for permanent closure, but a council vote kept it open through this month.

“You need to add that it’s the most neglected,” said councilwoman Barbara Swearengen Holt, the impetus for putting Crockett back in the budget. “That’s how it got to be where it is now. … My desire and the desire of the people I serve in that area is that you take down the ‘For Sale’ sign.”

But the decision to keep the “country club of Frayser” open was a bit rough. The city owns eight public golf courses, including a brand new $5.2 million 9-hole course in Whitehaven that has yet to open and the recently revamped — but still closed — Riverside course south of downtown. Under a special enterprise fund, golf courses are supposed to be supported by their revenue rather than by tax dollars.

“When they moved it from the general fund 10 years ago, it was because at that time, golf was a sport that was becoming more popular,” parks director Cynthia Buchanan said via telephone. “It was seen as an operation that could support itself.”

But golf’s popularity is now on a downswing. To break even, Crockett needs to do about 30,000 rounds of golf a year. Currently, the parks division estimates it will only see about 8,000 rounds for the year.

Buchanan sees the course as an anchor for the Frayser community; because the citizens have rallied around it, there’s value in keeping it open. But during a council committee meeting, Buchanan said the problem wasn’t with the golf course but with trends in nearby development.

“The courses further east where new development tends to go … those courses attract enough people to break even or make a profit,” said Buchanan. “The courses further west, they don’t get a large number of players. It’s where your customers live. Generally, the golf course near where they live is where they’re going to play.”

Crockett may be able to attract players from outside the neighborhood because of its interesting terrain, but with two more public courses in nearby Millington, courses in Mississippi and in East Memphis, it’s a challenge.

And with golf season in Memphis stretching from March to October, some council members wondered if the course should be shuttered for the winter months, which Buchanan said would have a “minimal” financial impact to the city.

“I don’t see any point in keeping it open if no one’s going to be playing there,” said Carol Chumney.

But Holt championed keeping the facility open year-round. “The things we mothball usually rot away. … It’s just another way of saying we’re delaying the inevitable.”

But it’s this type of decision that puts the city closer to going in the hole. Barely anyone plays Davy Crockett during the golf season, but the city is going to spend $180,000 to keep it open through the winter when golfers aren’t on the links?

Don’t get me wrong — I’m all for local government providing amenities for its citizens. In discussions such as these, I often think back on something former Charleston mayor Joe Riley said: A great city is one that both poor people and rich people can love and enjoy.

And, as such, there are plenty of city amenities that are not required to pay for themselves: community centers, parks, ball fields. But a golf course is not like a library or a community center, serving a variety of citizens and uses.

Councilman Jack Sammons has employees who live in the area and said they were more focused on the mayor’s plan for a larger police force. “This golf course,” he said, “they could care less about. What they care about is seeing something happen in this community.”

Public amenities often raise the value of neighborhoods, but value is subjective. Our currency, for instance, isn’t based on the gold standard but in people believing that it’s valuable. Perhaps a lean budget and neglect have cause a once-viable amenity to deteriorate. But if the community isn’t interested in golfing, is it in the public’s interest to have a golf course there?

And maybe the bigger question isn’t about Davy Crockett but how many municipal golf courses does one city need?

Austin has five. Atlanta has six. We have eight, almost one for every council district.

“The bottom line is that golf courses are overbuilt across the United States,” said Buchanan. “All of the courses cannot be sustained with the number of golfers currently playing.”

And we’ve got newly built and renovated courses that aren’t even open yet. I’m not a golfer, but I know what it means to be teed off.
