Rep. Cohen Co-Sponsors Raft of Bills for Restaurant, Live Music Relief

Rep. Steve Cohen (D-Memphis) joined a bipartisan group of federal lawmakers last week to co-sponsor a $10 billion bill to help independent entertainment venues stay afloat during the pandemic.

The Save Our Stages (SOS) Act has broad support from congressional leaders, particularly those from districts or states dependent on live music for tourism, like Memphis and Tennessee. Lawmakers fanned out at live venues across the country earlier this week to push the bill.

The Senate version of the SOS Act would allow the Small Business Administration to make grants of up to $12 million to an eligible operator, promoter, producer, or talent representative to be used for cost incurred between March 1st and December 31, 2020. Another grant of up to $6 million could be used for costs incurred through June 30, 2021.

Last week, Cohen also pushed a raft of bills he’s co-sponsored for COVID-19 relief. The RESTART Act would extend the Paycheck Protection Program. The Real Economic Support That Acknowledges Unique Restaurant Assistance Needed To Survive (RESTAURANTS) Act would establish a $120 billion grant program for relief to restaurants through 2020.

The Mixed Earner Pandemic Unemployment Assistance Acts would allow those who earn a mix of paychecks from companies and from independent work (think musicians, here) to have access to the unemployment assistance provided in the CARES Act.

“Most musicians are facing unprecedented job loss with no end in sight,” said American Federation of Musicians president Ray Hair in a statement. “It is vital that musicians and others who have both W-2 and 1099 income are able to receive full unemployment benefits.”

Cohen said not being able to share meals and listen to live music “is having a dire impact on those who rely on these industries for their livelihoods.”

“As important as the music industry is to Tennessee, I’m surprised these measures have so far found no support from our Congressional delegation except from [Rep. Jim Cooper] and me,” Cohen said in a statement. “I hope calling attention to this crisis will result in some relief.

“Too many small restaurants are suffering greatly and are in danger of closing permanently. This will affect not just diners in Memphis and Nashville but the whole tourist industry.”

Head of Memphis Restaurant Association Urges, Businesses, Patrons to ‘Do Their Part’

The head of the Memphis Restaurant Association (MRA) said Thursday that the decisions made by the health department have a “huge impact” on the restaurant industry.

At an update of the Memphis and Shelby County COVID-19 Joint Task Force briefing Thursday, Ernie Mellor, president of MRA, said “these are truly challenging days and times for everybody, in particular in our industry. As most of you know, we have been hit as hard as anybody.”

Mellor said as the number if COVID-19 cases increase, the health department is having to make “tough decisions.”

“These decisions that they are making are for the safety of everyone, not just your next door neighbor, but us as restaurant owners and everybody in the county,” Mellor said. These decisions have a real impact on the livelihood of our industry, our employers, our employees, and their families. So I’ve asked Dr. Haushalter and her staff to please consider the economic impacts of their decisions before they take action.”

The latest directive from the health department asks that restaurants collect tracing data on its customers, recording the names and phone numbers of patrons. Mellor said this request “will be challenging for our members.”

Dr. Alisa Haushalter, director of the Shelby County Health Department said the purpose of this is to ensure the health department has the ability to contact people if they’ve been exposed in a restaurant setting.

Mellor encouraged all restaurants and patrons to follow the protocols of the health directive.

Haushalter added that the health department is prepared to go out and enforce protocols at restaurants and bars.

“We do rely on others bringing information to us and as we are able with the staffing that we have or with police and sheriff we will then respond or do more proactive checks,” Haushalter said. “We all want to move forward, being back to work and back to school. If one or two businesses don’t comply, it makes it much more difficult for every other business.”

Bars aren’t being “targeted,” Haushalter said. Instead, she said the department is relying on data and science to make decisions. The data shows that there is an increase in cases among individuals between the ages of 25 and 45 and that transmissions is occurring in social settings.

Haushalter also gave an update on the criteria for moving forward, which includes:

• The number and trend of cases, which is trending upward

• The positivity rate of tests, which should be below 10 percent. It’s currently at 8.6 percent overall

• The reproduction rate, which should be at 1 or below. That number is currently 1.2

• Testing capacity, which Haushalter said is “becoming more strained”

• Hospital capacity; Haushalter said hospitals are reporting they are currently able to manage number of cases coming in

• Public health capacity, which includes the ability to get people isolated quickly. Haushalter said this is “becoming more of a challenge”

“These are all red flags. When you look at all four gating criteria, we have red flags. We’re really straining the public health system. We ‘re beginning to strain the hospital system. We know our testing system is strained as well and our numbers are going up. So those are things that allow us to move us forward.”

Local Leaders Say Businesses Comply with Reopening Plan, So Far

Three days into Shelby County’s Back to Business plan, local officials said they’ve not had an increased uptick in calls to police or code enforcement for infractions to social distancing rules.

County retail shops and restaurants were allowed to open on a limited basis Monday. Many of our readers told us in a weekend poll that they wouldn’t rush to restaurants right away. However, Wednesday’s clear, warm weather came during the annual Cinco de Mayo celebration.

Even with that, city of Memphis Chief Operating Officer Doug McGowen said Mayor Jim Strickland and his adminstration have seen “broad-ranging compliance” with the Safer At Home order and, then, the Back to Business plan.
[pullquote-1] “Business owners are working so hard under that framework,” McGowen said, during the daily press briefing of the Shelby County COVID-19 Task Force. “It’s not easy. But those businesses and patrons of those businesses are complying in large measure.”

However, photos have circulated on social media that showed restaurants allegedly not adhering to the stipulations of the order. McGowen said a restaurant surge was expected Wednesday as the weather was coupled with the holiday. But he said there will be “outliers” in the process and stressed that most infractions of the order are part of a “learning process.”

“Many people just have not understood all the limits of the protocols,” he said. “We share information first and, then, if we see a lack of compliance [follow up with more direct interventions].”

Alisa Haushalter, director of the Shelby County Health Department, said her agency has not received many complaints about companies not adhering to the rules. Mostly, the agency gets questions from companies “about how to most effectively keep employees and customers safe.”

“The majority of employers want to do what’s right for their employees and their clientele,” Haushalter said during Wednesday briefing.
[pullquote-2] The briefing came as the county recorded its lowest amount of new cases in several weeks. The 613 tests given Tuesday yielded only 26 new coronavirus cases. This put the positivity test rating at around 4 percent.

More businesses will be allowed to open (and now-open businesses may be able to add capacity) if the new case rate begins to fall or remains somewhat steady. This metric and others will determine if the county will be bale to enter that second phase of Back to Business.

“We can really continue to mitigate [COVID-19] in our community and keep transmissions down and get back to business all at the same time if we keep on adhering to social distancing,” Haushalter said.

McGowen agreed, saying this “is no time to let our guards down.”

Flyer Readers Say ‘Hell No,’ There’s ‘Not A Chance’ They’ll Go to Restaurants Today

Two online polls this weekend found that Memphis Flyer readers are not yet ready to return to restaurants Monday.

Restaurants have the green light to return to business today, the first day since some stay-at-home restrictions were lifted by government leaders in Memphis and Shelby County.

Restrictions still apply even to those businesses that can re-open. Restaurants, for example, can only use half of its available seating, and restaurant employee must wear masks on the job.

While business, political, and medical officials here agreed to loosen some of the shelter-in-place restrictions, our readers agreed the time is not yet right for them to return to public dining rooms.

An overwhelming majority (83 percent!) of them responded “hell no” when asked in a Twitter poll Friday if they’d eat at a restaurant today. Only 12 percent answered “hell yes,” and 5 percent answered “maybe.”
[pullquote-1] Over on Instagram, 271 voters (of 301 total voters) said there’s “not a chance” they’d go to a restaurant today. Only 30 Instagram voters said “hell yes,” they’d go to a public dining room today.  

It’s uncertain how Monday’s return to business will play out. Many are eager to return to some sense of normalcy. Many others are still worried about the spread of the coronavirus here, even with the added restrictions of mandatory social distancing, masks, and more.

Many restaurants have said they will not open today. That list includes all Huey’s locations, all restaurants from chef Ryan Trimm, all restaurants from chef Kelly English, The Majestic Grille, and more.

Coronavirus: Mayor Strickland Expected to Close All Restaurant Dining Rooms

In a note to its members Thursday afternoon, the Memphis Restaurant Association (MRA) said Memphis Mayor Jim Strickland is expected to soon announce that he’ll close all restaurant dining rooms to slow the spread of coronavirus here.

“I am sorry to say that we just got word from Mayor Strickland’s office that he will mandate the shut-down of restaurants,” MRA president Ernie Mellor, said in a email blast. “This pertains to dine-in only. You will still be able to operate take out, to-go, drive-thru, curbside, and delivery options.”

Mellor said he assumed Strickland meant the mandate takes effect at the end of business Thursday.

Coronavirus: Want to Help Local Restaurants? Try Buying ‘Dining Bonds’ or Gift Cards

Remember the good, old days of social closeness-ning?

If you are looking for ways to help support Memphis restaurants and bars and all of the folks here who make your going-out dreams come true, consider buying a gift card.

This notion is taking hold in other parts of the country as the restaurant industry braces for the full impact of social distancing that will leave tables and barstools empty for who knows how long.

As we reported yesterday, Railgarten will be selling deeply discounted gift cards at the bar and online beginning today at 2 p.m. For example, $100 will get you a $200 Railgarten gift card right at 2 p.m. At 3 p.m., you can get a $200 card for $125. Card prices increase every hour. Every in-person purchase will get you a free roll of toilet paper.
Dining Bonds Initiative

The biggest coordinated push across the country so far is the Dining Bond Initiative over at www.supportrestaurants.com. There, restaurants ranging from Long Island’s upscale Preston House & Hotel to the fun, kitschy Bigfoot Lodge in Los Angeles (and even the Sysco Corp.) have signed up to sell Dining Bonds.

”A Dining Bond works like a savings bond, where you can purchase a ‘bond’ at a value rate to be redeemed for face value (for example, a $100 bond for $75) at a future date,” according to the Dining Bond website. “For restaurants, many of whom are small businesses and are in serious risk of shutting their doors permanently due to this crisis, the bonds can bring in much needed revenue.

”And for us, the public, they’re a chance to show love and support, ensuring the future of some of their favorite restaurants, not to mention the many people who may be forced out of work.”

Eater, the online newsmagazine, published a list of several different such pushes happening across the country. It mentions the Dining Bond Initiative but also the Grubhub Community Relief Fund, the Southern Smoke Foundation (to aid those affected by the cancellation of SXSW), Giving Kitchen in Georgia, and more.

Over in the Adams Morgan neighborhood of Washington D.C., organizers there are asking locals to buy “Restaurant Bonds —similar to ’war bonds’ during WWI and II.” The organizers explained the gift cards can “act as a micro-loan to restaurants to provide much-needed immediate cash.” Also, these can be purchased online so customers can show support without having to leave home. “There has never been a more important time to support our neighborhood’s culinary scene,” reads a news release from the Adams Morgan Partnership Business Improvement District. “Restaurants are emptying out and small business owners are seeing up to an 80 percent drop-off in customers.

“Restaurants already work off razor-thin profit margins, but the COVID-19 pandemic is a test like no other. We have heard that restaurants in Adams Morgan and across D.C. are scrambling to cover expenses and to make payroll with no idea what new changes tomorrow will bring.

For now, the best thing our friends and neighbors in the community can do to help is to order takeout or buy gift cards to ensure at least some income during this difficult time.

Everyday Climate Change: A Hot September for Patios

Everyday Climate Change is an occasional series from the Memphis Flyer about the ways climate change is already affecting our everyday lives.

Memphis sighed a collective ahhhh! over the last few days as a hot September — the hottest ever on record — closed and unofficially reopened patio season at bars and restaurants all over town.

Hottest ever? Yes. The National Weather Service (NWS) tweeted on October 1st that September’s average temperatures were 8.3 degrees above normal for the month. The month’s average temperature was 83.5 degrees, and the average maximum temperature was 93.7 degrees.

“Memphis just experienced the warmest September in its 144-year climatological record,” tweeted the NWS.

Are heatwaves caused by climate change? Yes, according to scientists. In a paper presented at last year’s European Geosciences Union Conference, scientists said that 2018’s heatwaves across North America, Europe, and Asia were maybe the first ever attributable to climate change.
[pullquote-2] “We demonstrate that it is virtually certain that a 2018-like heatwave area could not have occurred without human-induced climate change,” according to the paper. “Thus, the 2018 global-scale heatwave event possibly constitutes the first climate phenomenon that can be uniquely attributed to human-induced global warming.”

Those heatwaves killed hundreds of people, triggered wildfires and crop failure, and damaged infrastructure across the globe, according to the paper.

Memphians are used to heat, a fact they brag about (almost as much as the city’s water quality). But this year’s heat put it to the test.

For example, two dogs died from heat stroke after a visit to Shelby Farms Park. The heat this year put a big dent in the crowd size of the Cooper-Young Festival, down about 15,000-20,000 people according to Tamara Cook, executive director of the Cooper-Young Business Association.

“It was just fantastically hot,” Walker told Flyer reporter Michael Donahue last month. “That’s what got everybody. We got hit by the heat. You didn’t see a lot of people standing in the sun in front of the main stage. People were standing in the shade.”

In this context, sitting on patios for drinks and dinner may seem a small thing. But Memphians love a patio. Drive through Cooper-Young or Downtown this weekend and see for yourself.

While it looks fun to the consumer, it looks like big money to restaurateurs. Patios are attractive and enough, hopefully, to bring consumers through the door.

“We have the best patio in East Memphis, but if the heat scares you our air conditioning works also!” reads a July Facebook post from Patrick’s Neighborhood Restaurant & Bar.

“It certainly has been a hot few months, but we really haven’t seen a dip in our numbers because we’ve taken measures to ensure our patio is all-weather, especially in the brutal Memphis heat,” said Eric Bourgeois, marketing director at Packed House Productions, parent company of Slider Inn. “We’re one of the only Midtown bars with patio misters, and that really makes a difference when folks are looking for a spot to chill outside — especially when they want to ensure the comfort of their furry, four-legged friends.”

Similar efforts will be made at the also four-legged-friendly Slider Inn Downtown, Bourgeois said.
[pullquote-3] Weather in general affects consumers’ experiences in restaurants, according to a new study published in the “Journal of Hospitality and Tourism Research.” In “It’s Raining Complaints! How Weather Factors Drive Consumer Comments and Word-of-Mouth,” researchers found that restaurant-goers are more likely to leave more negative comments if “weather factors like temperature and rain become more unpleasant.”

The findings were significant enough for the researchers to suggest restaurant managers should give extra care to diners on bad-weather days and to be aware that more negative comments may be more common on those days.

The Union of Concerned Scientists said recently that if nothing is done to correct climate change, Memphis could have four days a year with a heat index of over 127 degrees and could have 119 days of temperatures over 90 degrees (we have only 77 of those now).

Industry experts are watching climate change closely. The hearth, barbecue, and patio industry may not yet see the effects of rising temperatures, but it will, according to James Houck, writing for trade journal “Hearth & Home” in 2017.

“Still it would be prudent for business owners, and and it would be consistent with the fiduciary duty of corporate officers, to follow developments in climate change science, public opinions, and governmental actions,” Houck wrote. “Climate change will affect the hearth, barbecue, and patio industries’ bottom line.”

Climate change will change outdoor recreation in general, according to experts who say much of those activities will be pushed to summers “shoulder months” of April and October.

Researchers with the U.S. Forest Service said snowmobiling, snowshoeing, and cross-country skiing will be the most negatively affected activities in national parks in the future. But climate will also impact hunting, fishing, water activities (though swimming should increase), and horseback riding.

Cafe Pontotoc To Open in Corked Carrot Space

Cafe Pontotoc, so named because it’s near the corner of Pontotoc and S. Main, will open in mid- to late-June, according to owner Milton Lamb.

Lamb says the restaurant will feature a great wine list and beer from local brewers. While the menu is still being worked out, Lamb says it will include a selection of small plates.

Cafe Pontotoc will be in the old Corked Carrot space at 314 S. Main. Lamb says that the space is much the same, though he’s brought in some new tables and redid the back bar.

Lamb says the restaurant will initially be open Tuesday to Saturday, starting at 4 p.m., and will eventually expand to 7 days a week. He’s also considering having a Sunday brunch.

Lamb calls Cafe Pontotoc a “nice neighborhood hangout.” It will be a place, he says, “to sit down and have a conversation.”
